These Terms of Service (“Terms”) govern your access to and use of attainmiami.com (the “Site”), operated by Attain, a registered fictitious name (DBA) of COTE Services LLC, a Florida limited liability company (“Attain,” “we,” “us,” or “our”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

1. Medical Disclaimer — No Medical Advice

The content on this Site is provided for general informational and marketing purposes only. It is not medical advice and is not a substitute for professional medical evaluation, diagnosis, or treatment.

  • No content on this Site creates a physician–patient or provider–patient relationship. Such a relationship is established only through an in-person or otherwise properly conducted consultation with one of our licensed providers.

3. Eligibility

4. Appointments and Booking

Appointment scheduling is provided through Aesthetic Record, a third-party practice management platform, via embedded forms or links on the Site. Your use of Aesthetic Record is subject to its own terms of service and privacy policy. Booking an appointment through the Site does not guarantee that you are a candidate for any particular treatment; candidacy is determined at your consultation.

We reserve the right to establish, modify, and enforce policies regarding appointment scheduling, cancellations, no-shows, deposits, and fees, which will be communicated to you at or before booking.

5. Pricing and Promotions

Any prices, promotions, or special offers displayed on the Site are subject to change without notice and may be subject to additional terms, restrictions, and expiration dates. Errors in pricing may be corrected at any time. Promotions cannot be applied retroactively and may not be combined unless expressly stated.

6. SMS and Email Communications

If you opt in to marketing communications, your participation is governed by the SMS and email terms described in our Privacy Policy. Consent to receive marketing messages is not a condition of purchasing any goods or services. Reply STOP to opt out of texts; use the unsubscribe link to opt out of emails.

“Attain” and associated logos are trademarks of COTE Services LLC. Nothing on the Site grants you any license or right to use any trademark displayed on the Site.

  • Attempt to gain unauthorized access to the Site, its servers, or any connected systems
  • Interfere with or disrupt the Site’s operation, including through viruses, scraping, bots, or automated tools
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity
  • Use the Site to harass, defame, or harm others

We may suspend or terminate your access to the Site at any time for violation of these Terms.

The Site may contain links to or integrations with third-party websites and services, including Aesthetic Record, Google, and social media platforms. These are provided for convenience only. We do not control and are not responsible for the content, terms, or privacy practices of any third party. Your use of third-party services is at your own risk and subject to their terms.

10. Disclaimer of Warranties

THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ATTAIN, COTE SERVICES LLC, AND THEIR RESPECTIVE OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

THIS SECTION APPLIES TO CLAIMS ARISING FROM USE OF THE SITE AND ITS CONTENT. You agree to indemnify, defend, and hold harmless Attain, COTE Services LLC, and their respective owners, officers, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your violation of these Terms or your misuse of the Site.

13. Governing Law and Venue

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Site shall be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to the personal jurisdiction of those courts.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

15. Changes to These Terms

We may revise these Terms at any time by posting an updated version on this page with a new “Last Updated” date. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
